TERMS AND CONDITIONS OF THE ONLINE STORE

These Terms and Conditions define the general terms, principles, and conditions of sale conducted by VAGAR SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, headquartered in Warsaw (00-233), ul. FRANCISZKAŃSKA 3, lok. 35, registered in the National Court Register (KRS) under number 0001006065, NIP (Tax ID): 5252934035, via the online store www.vagar.pl, and set out the rules and conditions for providing free electronic services by VAGAR Sp. z o.o.


§ 1. Definitions

Business Days – means the days from Monday to Friday, excluding public holidays.
Carrier – means the courier company cooperating with the Seller to deliver goods.
Password – means a string of letters, digits, or other characters chosen by the Customer during Registration, used to secure access to the Customer Account.
Customer – means any individual with full legal capacity, as well as any legal entity or organizational unit without legal personality that has legal capacity under separate provisions, placing an order in the Store.
Consumer – means an individual not engaged in business activity. It also includes a sole proprietor who makes a purchase not directly related to their business activity.
Regulations – these Terms and Conditions of the Store.
Product / Goods – means the products presented and offered for sale in the Online Store.
Online Store / Store – the website available at www.vagar.pl, through which the Customer may review the offer and place orders.
Sales Agreement – a distance sales contract concluded under these Terms between the Customer and the Seller.
Order – the Customer’s declaration of intent constituting an offer to conclude a Sales Agreement.

§ 2. General Provisions and Use of the Online Store

  1. All rights to the Online Store, including copyrights, intellectual property rights to its name, domain, layout, templates, photos, forms, and logos (except those belonging to third parties), belong to the Seller. Any use of these materials requires the Seller’s prior written consent.

  2. To place an order via the Online Store, the Customer must have an active e-mail account.

  3. To place an order by phone, the Customer must have an active phone number and an active e-mail account.


§ 3. Registration

To create a Customer Account, the Customer must complete a free Registration process.
Registration is not mandatory to place an order.
To register, the Customer must fill out the registration form provided on the Store’s website and submit it electronically. During registration, the Customer sets up an individual Password.
After submitting the form, the Customer receives an e-mail confirmation of successful registration. From that moment, the Customer Account is active, and the Customer may manage their data and orders.


§ 4. Orders

  1. Information displayed on the Store’s website does not constitute an offer within the meaning of the Civil Code but an invitation to place orders.

  2. Orders can be placed online 24/7 or by phone during business hours specified on the Store’s website.

  3. The Customer selects goods by adding them to the cart (“ADD TO CART”) and then chooses the delivery and payment method. To confirm the purchase, the Customer must click “Confirm purchase with payment obligation.”

  4. Each order confirmation includes the total price, delivery cost, and any other applicable charges.

  5. The order constitutes an offer to purchase.

  6. Orders must include personal or company details, delivery address, item description, quantity, and payment form.

  7. After placing the order, the Seller sends an order confirmation via e-mail.

  8. Once the order is accepted, the Seller sends a confirmation of order processing — this constitutes a Sales Agreement.

  9. The Seller will send the terms of the Sales Agreement to the Customer’s e-mail or in writing.


§ 5. Payment

  1. Prices shown include VAT but exclude delivery costs (displayed during checkout).

  2. Payment methods available:

    • Bank transfer, credit/debit card, or BLIK via przelewy24.pl (PayPro S.A., Poznań).

    • Direct bank transfer to the Seller’s account.

    • Cash on delivery (COD).

  3. The Seller may offer special payment terms individually.

  4. For bank transfer or card payments, payment should be made immediately after order confirmation.

  5. Bank transfers must include the order number and the note “online purchase.”


§ 6. Delivery

  1. Delivery costs depend on shipping method, size, and weight, per carrier’s rates.

  2. Orders are delivered via DPD, InPost, or other carriers depending on the product type.

  3. Delivery time includes:
    a) Order processing time;
    b) Transport time (varies by carrier and method).

  4. The Store is not responsible for delays caused by couriers.

  5. Products in stock are usually shipped the same or next business day (if ordered before 12:00).

  6. VAGAR platform scales are manufactured within 1–2 working days after receiving prepayment and shipped within 3 working days.

  7. Orders are fulfilled upon payment confirmation.

  8. The customer must inspect the package upon delivery and request a damage report if needed.

  9. If the parcel does not arrive, contact www.vagar.pl immediately.


§ 7. Invoicing

  1. Sales are invoiced in accordance with applicable law.

  2. VAT invoices are issued for businesses; named invoices — for individuals.

  3. Invoices are sent electronically or included with the shipment.

  4. The Seller reserves the right to require advance payment before order processing.

  5. Ownership of goods remains with the Seller until full payment is made.


§ 8. Warranty

  1. The Seller ensures the delivery of defect-free products.

  2. The warranty period is specified on the product page.

  3. Warranty covers manufacturing defects only.

  4. The warranty starts upon delivery and is valid in Poland.

  5. Repairs or replacements are carried out within a reasonable time.

  6. The warranty does not cover batteries, consumables, or damage due to improper use.

  7. Consumers retain legal rights under the Consumer Rights Act.

  8. Complaints are processed within 14 days of receipt.


§ 9. Withdrawal from the Sales Agreement

  1. Consumers and sole proprietors with consumer rights may withdraw within 14 days without reason.

  2. The withdrawal period starts upon receiving the goods.

  3. Notice of withdrawal can be sent in writing or via e-mail to info@vagar.pl.

  4. Refunds are processed within 14 days of receiving the withdrawal notice.

  5. The customer bears the return shipping cost.

  6. Refunds are made using the same payment method used for the purchase.


§ 10. Returns and Exchanges

  1. Non-consumer customers may return or exchange goods within 3 business days only with the Seller’s consent and provided:

    • The goods are unused, undamaged, and in original packaging.

    • They include all documentation and accessories.

  2. The Seller may deduct up to 30% of the product’s value.

§ 11. Free Services

The Seller provides the following free services electronically:

  • Online consultations (contact form)

  • Customer Account management

These services are available 24/7.
The Seller may modify or suspend them at any time, notifying customers of such changes.


§ 12. Personal Data Protection

Personal data is processed according to the Privacy Policy available on the website.


§ 13. Termination of Service Agreements

Both the Customer and Seller may terminate electronic service agreements at any time.
Termination must be submitted in writing or via e-mail.


§ 14. Final Provisions

  1. The Seller is liable only for damages caused intentionally.

  2. In case of disputes, parties will seek an amicable resolution.

  3. Polish law applies to these Terms and Conditions.

  4. The Seller is not liable for delays caused by force majeure (e.g., war, fire, flood, pandemic).

  5. The Seller reserves the right to amend these Terms. All orders placed before the changes are governed by the previous version.
